HD Comprehensive Trust Notes That Help You Structure Your Exam!
Subject notes for Monash LAW4170
Description
Each topic starts off with an exam structure which includes all relevant legislation and case principles which will help you write your answers to any problem questions. These notes go for 73 pages. At the end of the exam structured notes, you will find detailed notes regarding cases, some policy, and outdated law to further your understanding. This part of the notes (the last 107 pages) are not necessary for the exam, however, I have included them just in case you do not understand a case discussed in the exam structured part of the notes. I should also note that these notes were super helpful for the mid-semester test in semester 2, 2017. I was able to receive full marks by only using these notes. These notes contain the following topics: - Introduction and Classification of Trusts - Creation of an Express Trust which also includes - 1. Certainty of Intention - 2. Certainty of Subject Matter - 3. Certainty of Object Quistclose Trusts Charitable Trusts Formalities Constitution/Equitable Assignment Trustee Duties Trustee Exercising Powers and Discretions/Challenging a power of discretion Trustee Defences and Limitations of Liability Powers and Right of Trustees Rights and Remedies of Beneficiaries I have put a lot of effort into these notes, hours and hours of time to make sure they are as good as can be! They will be helpful in learning the unit and also when you are actually in the exam. Disclaimer: Although every effort has been made to ensure the accuracy of these notes, they may not be error free.
