Highly Comprehensive Competition and Consumer Law Script/Exam Notes (49/60 in exam)
Subject notes for Monash LAW5312
Description
These complete notes which contain all legislation and relevant cases were used in my exam and allowed me to score a HD (49/60) in the exam and a D (76) overall. These notes are formatted through coloured headings and sub headings that make the notes very easy to follow and understand for an exam situation. I utilise model/scripted responses with fill in the blanks as well as sample responses (for effective case analogising) which account for factually different exam scenarios. These model/scripted responses demonstrate how to write effectively and concisely in an exam and are a culmination of many arduous and long hours traversing legislation and case law to make it the strongest asset for my exam. All lectures, LSS tutorials and relevant textbook chapters from Corones’ Australian Consumer Law (4th ed) and Alex Bruce’s Australian Competition Law (4th ed) are covered. Also, I have included a summary document of content (with red flags) relating to consumer law and competition law. NB: I completed LAW4702 (Competition and Consumer law). LAW4702 is the LLB equivalent of LAW5312 for Competition Law. I have structured these notes as follows: Consumer Law Summaries 2 Liability of Manufacturers for Goods With Safety Defects 5 Consumer Guarantee (Part 3-2 ACL) 31 Unfair Contract Terms 77 Unconscionable Conduct (UCC) 97 Misleading or Deceptive Conduct (MDC) 111 Remedies 127 Competition Law Summaries 132 Markets, Market Power and Competition 138 Mergers 148 Misuse of Market Power (s46) 167 Anti-Competitive Agreements and Cartel Conduct 188 S47 Exclusive Dealings 216 Resale Price Maintenance (RPM) (Price Vertical Restraints) 237
