Description

The Commercial Law assessments consists of two case study questions, a negligence question and a contract law questions. These LAW2442 notes are designed to addressed the strict time limit of the test whilst still cover enough detail for full marks. A generic structure with gaps is provided which can be used as a guide alongside notes and case studies to assist in filling in these gaps depending on the question given. Please note that this answer guide also includes statute law references, the mid sem test primarily focuses on common or case law. Statutes have been added so that the answer guide can also be used in the exam, as there is a chance that you will get a negligence question in the final exam. However, if your case study question specifically asks "use common or case law", disregard the statute notes in the answer guide and focus on the structure and case laws as you can potentially lose marks for not differentiating between case and statute law. If your case study question says "advise of legal rights" or "using all areas of law" then the notes on statute law would be beneficial. The notes were compiled using the following sources RMIT Sources: -Feedback on practice questions from two tutors -Answer guides provided by course coordinator -Business Law Textbook External material purchased from the Law Institute of Victoria: - Thomas Reuters Law Briefs: Tort Law -LexisNexis Butterworths Questions & Answers: Torts LexisNexis Butterworths Questions & Answers: Contract Law -LexisNexis Butterworths Tort of Negligence Flow Chart -LexisNexis Butterworths Contract Law Flow Chart I -LexisNexis Butterworths Contract Law Flow Chart II My final mark for Commercial Law: HD
