Description

These are my Evidence notes from Semester 2 2025 (USYD LAWS2016/5013). I scored 88 (HD) using this document. 392 pages. This is the most complete set of notes I have made. It is a full textbook replacement, covers every topic and every required reading from the course guide, and is built entirely around exam use. If you want one document that gets you through the course and into the exam ready to write, this is it. WHAT IS INSIDE Pages 1–264: Full topic notes Every topic from the course guide, condensed into clear, exam-usable notes. Each topic covers the key principles, how the statutory tests under the Evidence Act 1995 (NSW) actually operate, and the cases you need to support an answer. Written as a textbook replacement, not a summary. Topics covered (as per the course guide): 1. Introduction to evidence law 2. Relevance 3. Proof (i) – burdens and standards of proof 4. Adversarial trial 5. Witnesses (competence, compellability, examination-in-chief, cross-examination, re-examination, unfavourable witnesses, vulnerable witnesses) 6. Documents and real evidence 7. Credibility evidence 8. Hearsay (rule, first-hand exceptions, business records, s 66A) 9. Tendency and coincidence evidence 10. Character of the accused 11. Opinion (lay, expert, s 137 discretion) 12. Discretions (ss 135, 137, 138) 13. Admissions (silence, oppression, reliability, improperly obtained, fairness) 14. Privilege against self-incrimination 15. Proof (ii) – judicial notice, inferences from absence of evidence, warnings (unreliable evidence, children, delay, forensic disadvantage) What the notes give you: - Statutory provisions broken down and explained in plain terms so you can apply them quickly under time pressure - Comprehensive case summaries for every case, written for exam use (facts/issue/held/principles) with pinpoints - The EA sections, key cases and tests integrated together so you are not piecing them together yourself Pages 265–392: Exam scaffolds (copy/paste) - Structured, step-by-step frameworks for every assessable topic. These are the exact frameworks I used in the exam. Copy them into a problem question and plug in the facts. - Each scaffold is set out with clean headings in the right order, pre-built reasoning chains, template sentences with placeholders, and the key EA provisions and cases positioned exactly where you need them. The goal is getting you from knowing the law to writing a high-mark answer fast, without blanking on structure under time pressure. because every topic is examinable in that format. WHY IT IS HELPFUL - Genuine textbook replacement, everything you need is in one place - 392 pages sounds like a lot, but the structure means you always know exactly where to go - The scaffolds remove the single biggest problem in an Evidence exam, which is knowing the law but losing marks on structure and sequencing under time pressure - Open book exam ready, copy the scaffold in, apply the facts, write the answer
