Clear, easy to understand, yet comprehensive set of notes on Torts and Contracts 2. This document includes notes on all relevant legislation and case law, which clearly defines the facts, decision and key principles of each case. IN ADDITION: These contain scaffolds which provide a clear step-by-step process for solving all types of problem questions with appropriate authorities for the mid-semester and final assessment. These scaffolds are very detailed (whilst still being easy to follow) and allowed me to do very well in the mid semester and final exams. I was wrote the SULS subject guides for TC2 and hence, these notes have been structured in a way that optimises study time and fosters a comprehensive understanding of the course work. Topics: 1. Introduction to Torts and Contracts II; tort and contractual liabilities and remedies in various contexts. 2. Causation and remoteness of damages in contract. 3. Measure of damages in contract. 4. Sums fixed by contract, including the law relating to penalties. 5. Introduction to vitiating factors and the remedy of rescission; mistake and duress. 6. Undue influence, unconscionable conduct and unfair contract terms. 7. Misrepresentation at general law and statutory liability for misleading or deceptive conduct. 8. Introduction to torts section of course; trespass to land plus statutory liability for damage by aircraft. 9. Private nuisance; tort liability for interference with goods. 10. Pure economic loss (PEL) in negligence: negligent misstatements and professional negligence. 11: PEL from third party property damage and third party personal injury. 12. PEL from defective structures and products; multiple wrongdoers – proportionate liability.
