Description

These are comprehensive Employment Law notes. They have been created and written with hypo and essay content in mind; it contains both steps to go through as well as information for you to discuss. I also have additional content from the secondary readings that could be useful for you; contact me once you've purchased the notes and I'll be happy to supply them. The notes also have multiple tables (please see FREE sample for example regarding redundancy) that I have made in order to make the FWA's complicated provisions a bit more palatable and clearer. These notes took me a full week to make before a during SWOTVAC; the issue with employment law and why the notes took me so long is that there are so many provisions in the FWA that you will need to cite for each claim/application. These notes have them all for you in an easy and ordered manner (see FREE sample). Moreover, sometimes the exam will test you on the actual procedure of applying for orders from the FWC and the possible remedies; these have been included in the notes in case of that. Additionally, it is always possible to criticise the FWA for its mediocre procedure and remedies in your essay. Either way, the notes will help you with that. Topics include: Categories of employees under the FWA, NES (Max working hours, Flexible working arrangements, annual leave, personal/carer's leave, domestic violence leave, termination notice, redundancy, casual conversion), MAs, EAs, Industrial Action, Compliance and Enforcement, Common Law Contracts, Discrimination, Adverse Action, Unfair Dismissal, Orders to Stop Bullying/Sexual Harassment, Work Health and Safety. NOTE: some of the NES entitlements are not examinable (eg. community service leave); they have been marked with NA.
