Description

These are comprehensive and streamlined notes for Remedies which can help you succeed in what is probably one of the most difficult and confusing subjects in the JD. They are structured in line with how you will answer any question in the exam. You just need to follow down the reasoning paths from beginning to end; I have restructured each individual topic in order to do this. Please see FREE sample for example of this. At many points in the notes, there will useful non-optional tips telling you to 'CONSIDER' or 'NOTE'. These notations are the issues that may give you marks for discussion in the exam. Important points have also been underlined. At points I have written the threshold/preliminary sentences which you can paraphrase for insertion into your own answer. NOTE: All of the content included will most likely come up on the exam because remedies law barely changes over the years. If anything the disagreement in these notes are only further entrenched. They may not be colourful or highlighted, but these notes are everything you need to successfully answer the hypo component of the exam. It will also provide a sound foundation for the essay, including all disagreements in judicial reasoning. Topics include: Compensatory Damages (Contract, Torts, Equity, ACL), Penalties v Damages, Normative Damages, Exemplary Damages, Specific Performance, Injunctions, LCA Damages, Gain Based Damages and Recission)
