A comprehensive and recent set of notes for the Unimelb subject Obligations LAWS50026. Concise enough to work quickly through, but with enough detail to take into an exam and earn an H1. I found the formulaic, logical style of problem-solving in law a new concept to grapple with coming from an Arts undergrad: with this in mind I created these notes with clear statements of the rule, sub-rule and any testing for each legal issue the subject deals with. Organised using subheadings, colour and highlighting around the subject modules: 1. Agreement 2. Consideration 3. Certainty 4. Intention 5. Formalities, Capacity & Property 6. Privity 7. Misleading or Deceptive Conduct 8. Estoppel 9. Restitution Note: while the necessary statute/case law which underpins the issue is provided (often with outlines on why it affects the law) these are not notes on case law summaries. I recommend learning the case law mentally anyway and using these exam notes for prompts; in the short time frame of the exam, reading detail on cases is virtually impossible anyway.
