Description
I used these consolidated notes for my Criminal Law and Procedure exam in Semester 1, 2017. These notes are mostly in the form of processes. The notes contain the processes for element analysis, the main offences, that is, dishonesty offences, unlawful killing, non-fatal offences against the person and sexual offences and extended liability (attempts, joint criminal enterprise, agency). The notes also contain the defences of circumstance (self-defence, duress and necessity) and the defences of mental state (intoxication and mental impairment, along with a section which provides an overview of basic criminal procedure (police powers, exclusion of evidence, duties of practitioners/fair trial, bail, sentencing). Please be aware that the Criminal Law (Sentencing) Act 1988 (SA) has been repealed to the Sentencing Act 2017 (SA).
