LAW5013 - Litigation and Dispute Resolution Exam Script (91 HD)
Subject notes for Monash LAW4303/LAW5013
Description
This is a comprehensive exam script (completely up to date) which I have derived from many reliable resources, but put together in a way that seems most logical to me. Working in the LDR team at a law firm, I was exposed to many resources that I used to consolidate these notes. It is very easy to follow and there are various bookmarks and hyperlinks to make navigating easier. These notes are also ideal for exam conditions and practise exams. Topics covered are: 1. CPA - Overarching Obligations 2. ADR and ODR 3. Jurisdiction (including cross-vesting) 4. Parties (capacity etc.) 5. Joinder (party joining a proceeding - P, D or 3P) 6. Joinder sub-topic (estoppel) 7. Commencing Proceedings (including Pre-Litigation Steps and Ethical Obligations) 8. Limitations of Actions 9. Originating Process 10. Service (Personal, Ordinary & Substituted) 11. Appearance (Unconditional & Conditional) 12. Class Actions (how to commence proceedings as a class action) 13. Urgent Applications & protection orders (Urgent injunctions, search orders, security for costs and freezing orders) 14. Pleadings - ethical obligations 15. The Pleadings Process 16. Methods of gathering evidence and Discovery process (very examinable) 17. Legal costs 18. Disposition (including settlement offers like Calderbank or OOC) 19. Enforcement (when judgment is not complied to). My tip is to use these notes as a first step for doing practise questions and understanding the content, and then to use as a guide for creating your own exam notes which are catered to your understanding of the material. At the very least, know the content and notes very well so that you can issue spot. Although the notes provide step-by-step analysis, it is not necessary or appropriate to go through every step for every exam question. All the best and happy studying :)
