LAW5004 Public Law and Statutory Interpretation Exam Template
Subject notes for Monash LAW5004
Description
This template provides step-by-step instructions and answer prompts for the problem solving question relating to statutory interpretation (the bulk of the exam marks). It is thorough but very easy to follow with option templates for different outcomes (contentious, not contentious etc.) Using this template, I received an 82 HD for the exam. The structure of this template is: - Analysis of the legislation (overarching effect/purpose, restrictions on fundamental common law rights and system/schemes) - Introduction - terms requiring interpretation - Illumination - Broad meaning and Narrow meaning + Rules - Context/Textual - Immediate context, Syntactical presumptions - Broader Context + Rules - Purpose - Intrinsic Material + EMS + Golden Rule - Presumptions of Interpretation - Relevancy + 3 Step process + Legislative intent - Court's Decision and Reason Conclusion Please note that this template was customised for the legislation that was provided prior to our exam although the majority of it remains relevant and demonstrates how I prepared for the exam and anticipated what would be relevant for the exam. Please also note that the legislation for this exam was (Cth) and not (Vic).
