Policy concerns and the modern approach to duty in novel PEL cases 2. Relational economic loss 3. Negligent misstatements - Reputation and Privacy, covering: 1. Defamation basics (matter, defamatory meaning, context, extended meanings, serious harm, publication, reference to the plaintiff) 2. Defences to defamation (truth/justification, honest opinion, qualified privilege in its traditional, extended/Lange, and statutory forms, and the public interest defence under s 29A) 3. Invasions of privacy (the "persistent privacy gap," breach of confidence developments, proposed common-law privacy torts, and the new statutory tort under the Privacy Act 1988) Vicarious Liability, covering: 1. The forms and rationale of vicarious liability 2. Defining the employment relationship 3. The "course of employment" test 4. Intentional and criminal acts Alternative Compensation Schemes - covering litigation-based compensation, social insurance (NDIS/NIIS), no-fault schemes, and Queensland-specific frameworks (workers' compensation, motor vehicle accidents, CTP insurance). These helped me achieve final exam grade of 83/100.
