Description

These scaffolds are designed to be hyper-condensed distillations of a very large body of law, hence their size. Expect lots of colour! Lots of headings! and subheadings! Tables (with more colour!!) These will be good for you if you get overwhelmed during exams (at least they are for me). I try to format things in a way that guides your eyes towards key principles. These notes cover: - Types Equitable Property/Interests (charge, lien, security, mortgage) - Fiduciary Obligations (existence, recognised categories, scope, breach etc) - Breach of Trust (duties) + Defences - Trustee and Beneficiary Rights (rule in Saunders v Vautier) - Accessorial Liability (Barnes v Addy and more) - Priority Rules - Equitable Personal Remedies - Equitable Proprietary Remedies (constructive and resulting trusts etc) [did not cover equitable liens in depth] - Bars to Relief
